Terms and Conditions

These General Conditions regulate the acquisition of the products and services offered on the website www.misslion.com, owned by Kena Alberi Roca (hereinafter, MISS LION).

The acquisition of any of the products and services entails the full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Particular Conditions that may be applicable when acquiring certain products and services.

These General Conditions may be modified without prior notification, therefore, it is advisable to carefully read their content before proceeding to purchase any of the products and services offered.

1. IDENTIFICATION

MISS LION, in compliance with Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, informs you that:

All notifications and communications between users and MISS LION will be considered effective, for all purposes, when they are made through any of the means detailed above.

3. PRODUCTS AND SERVICES

The products and services offered, along with their main characteristics and their price, appear on the screen.

MISS LION reserves the right to decide, at any time, the products and/or services offered to Clients. In this way, MISS LION may, at any time, add new products and/or services to those currently offered. Likewise, MISS LION reserves the right to withdraw or stop offering, at any time, and without prior notice, any of the products and services offered.

All this without prejudice to the fact that the acquisition of any of the products and services can only be done through the subscription or registration of the USER, granting by MISS LION to the interested party a User name and a password, which will personally identify and enable them to have access to products and services.

Once inside www.misslion.com, and to access the contracting of the different products and services, the User must follow all the instructions indicated in the purchase process, which will mean the reading and acceptance of all the general conditions and individuals posted on www.misslion.com.

OBSERVATIONS

The user must register to be able to purchase the product in the online store.

4. AVAILABILITY AND SUBSTITUTIONS

PRODUCTS

MISS LION intends to guarantee the availability of all products that are advertised through www.misslion.com. However, in the event that any requested product is not available or if it is out of stock, the customer will be informed. All orders are subject to their availability. If there are difficulties regarding its supply or stock, substitute products may be offered, but if the change is not desired, we will refund the amount paid as soon as possible.

If the product is not available, and the consumer has been informed of this, MISS LION may supply a product with similar characteristics without an increase in price, in which case, the consumer may accept or reject it, exercising their right of withdrawal and termination of the contract.

In case of unavailability of all or part of the order, and the rejection of the replacement products by the customer, the refund previously paid will be made by the same means of payment used.

If MISS LION is unjustifiably late in returning the amounts paid, the consumer may claim double the amount owed.

SERVICES

MISS LION is not responsible for any damages that may occur to tell USER as a result of failures or disconnections in the telecommunications networks and that cause suspension, cancellation or interruption of the www.misslion.com service during its provision.

5. PURCHASE AND/OR CONTRACTING PROCESS

To make any purchase on www.misslion.com, the customer must be of legal age.

It will also be necessary for the client to register at www.misslion.com through a data collection form in which MISS LION is provided with the necessary information for contracting; data that in any case will be true, exact and complete about their identity and that the client must expressly consent to by accepting the privacy policy of MISS LION.

The steps to follow to make the purchase are:

Step 1: Access www.misslion.com and open the menu window that you will find on the left of the screen.
Step 2: Select the SHOP section or browse our landing page.
Step 3: Select the product you want, size and quantity.
Step 4: Select the button.
Step 5: If you have finished your purchase, go to your cart located on the right hand side and click on.
Step 6: Once all the information required for delivery has been entered, follow the steps according to the selected payment method to complete the purchase process.

It is also recommended that the customer print and/or save a copy of the conditions of sale on a durable medium when placing their order, as well as the proof of receipt sent by MISS LION by email.

OBSERVATIONS

The contract is a virtual process that saves the data provided by the client and stored in a database owned by MISS LION with access by the client through the purchase process to carry out the procedures associated with it.

BILLING

Together with your order, you will receive the corresponding invoice. To this end, the client consents to the invoice being sent in electronic format. The client will receive it by email once it has been paid and in the event that it is explicitly requested in the purchase form or by email to info@misslion.es You may, at any time, revoke this consent. To receive the paper invoice, said invoice will be sent after placing the order.

OBSERVATIONS

The physical invoice will be delivered at the store if requested.

6. DELIVERY

PRODUCTS

The order will be delivered to the address designated by the client at the time of contracting according to the chosen method.

The delivery perimeter includes the following areas: Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla and EU member countries.

SERVICES

The service shall be provided in the following manner:

Shipments are managed through the company DHL. Delivery times vary depending on the destination of the shipment.

Standard shipments to Spain and Portugal take an average of 48 and 72 working hours (Monday to Friday, working days). For shipments to other countries of the European Union and international deadlines can be extended between 7 and 15 working days from the time of shipment.

Shipping process: All shipments are made from Monday to Friday Business mornings. Orders placed after 2:00 p.m. can be shipped the next business day. Orders placed on Friday afternoons, Saturdays and Sundays are prepared and shipped the following Monday. Deliveries are only made on working days.

In periods of promotions, sales or parties, exceptionally, delivery times may be affected.

Orders are prepared and shipped from our warehouse in Barcelona, so city holidays will affect delivery times.

In the event that, due to an exceptional case, we do not have any product of the order, we will inform you by email or telephone and we will offer you an alternative solution or a refund.

REMEMBER that shipments are not made to PO Boxes, therefore it is necessary that you detail in the exact delivery address.

FORMS AND DELIVERY DEADLINES

PENINSULA, BALEARIC ISLANDS, CANARY ISLANDS AND ANDORRA.

1. Shipping to Catalonia:

Certified delivery with DHL at home at a cost of €5.60 VAT included.

The maximum delivery time is 3 days.

2. Shipping to Other Autonomous Communities of Spain:

Certified delivery with DHL at home at a cost of €6.25 VAT included.

The maximum delivery time is 3 days.

3. Shipping to the Balearic Islands (Except Formentera):

Certified delivery with DHL at home at a cost of €7.75 VAT included.

The maximum delivery time is 3 days.

4. Shipping to Canary Islands:

Certified delivery with DHL at home at a cost of €41.20 VAT included.

The maximum delivery time is 8 days.

5. Shipping to Ceuta, Melilla, Formentera and Andorra:

Certified delivery with DHL at home at a cost of €22.50 VAT included.

The maximum delivery time is 5 days.

6. Shipping to Portugal:

Certified delivery with DHL at home at a cost of €7.65 VAT included.

The maximum delivery time is 3 days.

EUROPEAN UNION COUNTRIES.

7. Shipping to Germany:

Certified delivery with DHL at home at a cost of €11.20 VAT included.

The maximum delivery time is 4 days.

8. Shipping to France:

Certified delivery with DHL at home at a cost of €13.15 VAT included.

The maximum delivery time is 4 days.

9. Shipping to Italy:

Certified delivery with DHL at home at a cost of €15.55 VAT included.

The maximum delivery time is 4 days.

10. Shipping to Austria, Belgium, Croatia, Slovenia, Netherlands, Hungary, Luxembourg, Poland, Czech Republic, Romania:

Certified delivery with DHL at home at a cost of €15.25 VAT included.

The maximum delivery time is 7 days.

11. Shipping to UK, Bulgaria, Estonia, Greece, Ireland, Latvia, Lithuania:

Certified delivery with DHL at home at a cost of €18.90 VAT included.

The maximum delivery time is 10 days.

11. Shipping to Denmark, Sweden, Finland:

Certified delivery with DHL at home at a cost of €31.65 VAT included.

The maximum delivery time is 7 days.

8. PRICES, EXPENSES AND TAXES

The prices of the products and services that are collected in www.misslion.com will be expressed in Euros unless otherwise stated and will be guaranteed during the time of validity of the same, except for printing errors and whatever the destination of the order. .

PRODUCTS

The final prices of all products, (and where appropriate, the final prices per unit of measure, when required) along with their characteristics, offers, discounts, etc., are reflected in each of the items that appear in the catalog at www.misslion.com.

  • The products have VAT included.
  • The VAT rate is 21%.
  • Shipping costs: Shipping costs not included in the price of the product.
  • Other additional expenses: The price may be affected by additional expenses related to the payment method that the user decides to use.

Product prices may change at any time. In this case, the price to be applied will be the one in force on the date of placing the order. In any case, the final cost will be communicated to the customer in the electronic purchase process before he formalizes his acceptance.

9. METHODS OF PAYMENT

The following payment methods are available:

a. By credit or debit card

You can make the payment immediately through our Bank’s secure SSL payment gateway. If it is necessary to make any return or cancellation of the order, the amount will be refunded through the same payment card.

b. PayPal

Through PayPal the payment of the order will be authorized, but no money will be withdrawn until PayPal verifies that it is correct. For this, it will be necessary to have a PayPal account.

10. RETURN AND WITHDRAWAL POLICY

According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without the need to indicate the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, approving the aforementioned text of the General Law for the Defense of Consumers and Users.

This right of withdrawal is not applicable, among others, to:

  • Provision of services already executed or started.
  • Contracts for the supply of products made according to the specifications of the consumer and user or, clearly personalized, or that by their nature cannot be returned or may deteriorate or expire quickly.
  • Supply of sealed goods that cannot be returned for reasons of health or hygiene.

PRODUCTS

The client will have a maximum period of 14 calendar days from the day of receipt of the requested good or product to inform MISS LION of their desire to withdraw from the contract.

Withdrawal implies that MISS LION will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided that the purchased product is not within the exceptions listed above).

During this period, the consumer will notify the entrepreneur of his decision to withdraw from the contract by sending an e-mail to info@misslion.es with the subject: “Return”.

MISS LION will communicate to the consumer in a durable medium an acknowledgment of receipt of said withdrawal.

To proceed with the return of a product it is essential that it is in perfect condition and with its corresponding original packaging, with all its accessories and without having been used.

Once we receive your request, we will contact the customer to indicate the details of the return.

The customer will bear the costs of returning the goods.

OBSERVATIONS

You can return an item within 14 calendar days from the date you received the product.

Due to the nature and timing of Party items, returns will only be made through a DISCOUNT VOUCHER with the amount and no expiration date.

Returns of custom-made products, underwear or items that cannot be returned for hygiene reasons such as body or earrings will not be accepted.

The garments and accessories to be returned must be new, unused and with the original labels and packaging.

To manage the return you must send an e-mail to info@misslion.es with the subject: “Return”. Upon receiving the form, we will contact you to indicate the steps to follow for the return.

The expenses derived from the sending of the return are borne by the customer. The shipment must be certified to be able to check its status and location at any time. Returns will be made through the DHL company.

In case of wanting a new size or garment, the client can contact us through this email: info@misslion.es. You will be told how to proceed to change the garment. Service subject to garment availability.

MISS LION reserves the right not to accept returns when:

  1. The return notice is outside the stipulated period.
  2. Return shipments outside the deadline.
  3. Product without label.
  4. Product used or in poor condition.
  5. Loss of packages NOT certified.
  6. More than two returns have been made with the same coupon.

SERVICES

The term to withdraw from the contract for the provision of services is 14 calendar days from the day of the conclusion of the contract, and the user must inform MISS LION of their desire to exercise such right, which they can do by filling out the form found at the end of this document.

The exercise of the right of withdrawal gives rise to the suspension of the service.

MISS LION will communicate to the consumer in a durable medium an acknowledgment of receipt of said withdrawal.

Withdrawal implies that MISS LION will proceed to refund the amount already paid by the client within a maximum period of 14 calendar days, following the same procedure chosen by the client for its payment (provided that the contracted service is not within the exceptions listed above).

Once we receive your request, we will contact the customer to indicate the details of the return.

11. WARRANTY

Products purchased through www.misslion.com enjoy a warranty period from the time of purchase, which covers possible manufacturing defects in the product, as well as any breakdown occurring during said period.

At MISS LION we work so that all the products we send are in perfect condition.

In case of receiving a garment in poor condition or with a factory defect, the customer must notify it within a maximum period of 48 hours upon receipt of the order, by sending an email to info@misslion.es indicating their order number, garments with damage and attaching the photographs of the garment.

We will review the request within a maximum period of 48 hours. Once the request has been evaluated and accepted, the piece will be replaced if it is available, at no cost to the customer. In case of not having enough stock, an alternative solution will be offered as a change of garment, coupon or refund if applicable.

Excluded from the guarantees are consumable products, deficiencies caused by improper use or manipulation, connection to the electrical network other than that indicated, incorrect installation or defects derived from any external cause.

In products of a durable nature, the consumer will have the right to an adequate technical service and the existence of spare parts for a minimum of 5 years from the date on which the product ceases to be manufactured, without the price of the spare parts being able to be increased when applying them in the repairs.

To avoid problems with the installation or operation of the purchased product, please ensure that you have followed the installation and operating instructions contained in the user manuals.

If even so, the purchased product does not work correctly, you should immediately contact the manufacturer’s customer service and technical assistance, or, where appropriate, the representative or distributor.

Technical services will usually require you to provide them with the following information:

  • Invoice number.
  • Identification of the specific model.
  • Serial number.

OBSERVATIONS

We reserve the right not to apply guarantees in the following cases:

– Communication of the tare within 48 hours of receiving the order.
– Natural wear of garments due to use.
– Misuse of garments.
– Garments poorly preserved, without following the guidelines marked on the label.
– Garments modified or manipulated by the client.

12. LIABILITY AND RELEASE OF LIABILITY

The consumer and user have the right to repair the product, its replacement, a price reduction or the termination of the contract, as established in Chapter II Title. IV Book II of the General Law for the Defense of Consumers and Users.

If the product is not in accordance with the contract, the consumer may choose between the repair or replacement of the product, both being free for the consumer, which will be carried out within a reasonable period of time depending on the nature of the products. And the purpose for which they were intended.

If the repair is completed and the product is delivered, it is still not in accordance with the contract, the consumer may demand its replacement, the price reduction or the termination of the contract.

MISS LION may suspend, withdraw or partially or totally cancel the services subject to contracting at any time and without the need for prior notice. The previous provision will not affect those services that are reserved for registered users or that are subject to prior contract and that will be governed by their specific conditions.

13. CUSTOMER SERVICE AND CLAIMS

To file any complaint or claim with MISS LION, the client must contact the customer service department either at the telephone number 936845943, or through the email address info@misslion.es

According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform that is available at the following link: http://ec.europa.eu/consumers/odr/.

14. APPLICABLE LEGISLATION

The present conditions will be governed by the current Spanish legislation.

The language used will be in Spanish.
